Terms of service

These terms cover cloud.kkaii.xyz, the thencloud server run by a private person in Poland (the “operator”, “we”). By creating an account or using the service, you agree to them. Contact: contact@kkaii.xyz.

thencloud itself is open-source software under its own licence. These terms are about this server, not the software.

The service

cloud.kkaii.xyz stores your files end-to-end encrypted. It’s run privately and offered free of charge, by invitation or at the operator’s discretion. There’s no guaranteed uptime, support or capacity, and features may change or be removed.

Your account

  • You’re responsible for your password, recovery key and second sign-in step, and for what’s done with your account.
  • We can’t reset your password or recover your files. The server can’t decrypt your data, so if you lose your password and your recovery key, your files are gone for good. Keep the recovery key somewhere safe.
  • Your account has a storage quota and may have daily transfer limits, set by the operator.

Acceptable use

Don’t use the service to:

  • store or share anything illegal under Polish or EU law, including child sexual abuse material, or content that infringes someone else’s copyright or other rights;
  • distribute malware or run phishing;
  • attack, overload or probe the service or other people’s accounts, or get around quotas and limits;
  • harass or harm other people through shares, comments or public links.

Because your data is encrypted, we don’t and can’t scan it. We act on reports and on what the law requires of us.

Google Drive

If you link a Google Drive, you also have to follow Google’s terms, and what’s kept there counts against your Google storage. We only use the access you give us as described in the privacy policy. You can unlink at any time.

Your content

Your files stay yours. You give us only the permission needed to store, copy (for backups and linked storage) and serve your encrypted data to you and to the people you share it with.

Ending the service

  • You can delete your account at any time in Settings. That deletes your data from the server; encrypted backups age out within 12 months.
  • We may suspend or delete an account that breaks these terms, or that we’re legally required to act on. Where we can, we’ll warn you first and give you time to export your data.
  • If we shut the service down, we’ll give at least 30 days’ notice so you can take your data out.

No warranty

The service is provided as is, without warranties of any kind. Keep your own copies of anything important. As far as the law allows, we aren’t liable for lost data, downtime or indirect damages. Nothing in these terms limits liability that can’t be limited by law, or your rights as a consumer.

Law

These terms are governed by Polish law. If you’re a consumer in the EU, you also keep the protections of the law where you live.

Changes

If these terms change, the new version is published here with a new date. For significant changes we’ll tell account holders before they take effect. Using the service after that means you accept the new terms.
